Terms governing your use of DeliaAutomation services and messaging programs.
1. Agreement to Terms
By accessing our website, using our services, or opting in to our messaging programs, you agree to be bound by these Terms and Conditions. If you do not agree, please do not use our services.
"DeliaAutomation" refers to the business operated by Hayden Delia, providing AI automation services to home service businesses in Orlando, Brevard County, and surrounding areas in Florida.
2. Services
DeliaAutomation provides AI-powered automation systems for home service businesses, including but not limited to:
- AI voice receptionist and call handling systems
- Automated SMS/text message lead notifications and customer communications
- Speed-to-lead automation and missed call text-back systems
- Appointment booking and scheduling automation
- Follow-up sequences, review collection, and maintenance reminders
- Custom workflow automation and internal process optimization
Services are provided on a subscription basis as agreed upon during your consultation. Specific service terms, pricing, and scope will be outlined in your individual service agreement.
3. SMS/Text Messaging Program (DeliaAutomation Number)
DeliaAutomation operates a B2B SMS messaging program from its own business phone number, used to communicate with HVAC and home service business owners, prospects, and active clients. By opting in (via the SMS consent form on this website, by signing a service agreement that authorizes SMS contact, or by other documented written or verbal consent), you agree to the following:
- Program Name: DeliaAutomation Account & Demo Updates
- Sender: DeliaAutomation
- Recipients: Authorized representatives of HVAC and home service businesses — owners, decision-makers, prospects in our sales pipeline, and active DeliaAutomation clients. This program does not message homeowners or end consumers of any HVAC company.
- Message Types: Demo scheduling and confirmations, onboarding progress updates, system status alerts, lead notifications routed to you as the business owner, account notifications, billing notifications, and customer support replies.
- Message Frequency: Message frequency varies based on your stage in our pipeline and active services. You may receive several messages per week during onboarding or while leads are being routed.
- Message and Data Rates: Standard message and data rates may apply. Contact your wireless carrier for details about your messaging plan.
- Opt-Out: You can opt out at any time by replying STOP to any text message from us. You will receive a confirmation message and no further messages will be sent.
- Help: For assistance, reply HELP to any message or email us at hayden@deliaautomation.com.
- Supported Carriers: Our SMS services are compatible with all major US wireless carriers including AT&T, Verizon, T-Mobile, and others.
Consent to receive text messages is not a condition of purchasing any goods or services. You may opt out at any time without affecting your service agreement.
3a. Separate SMS Programs Operated By Our Clients
As part of the automation services we deliver, each DeliaAutomation client (an HVAC or home service business) may operate their own SMS messaging program from their own dedicated phone number to communicate with their own customers — for example, appointment confirmations, technician arrival notifications, missed-call text-backs, and service follow-ups.
Those programs are operated by, branded as, and the legal responsibility of the individual HVAC company. Consent for those messages is collected on the HVAC company's own website, booking form, intake form, or approved opt-in flow — not on deliaautomation.com. Phone numbers, sender identity, opt-in records, and privacy policies for those programs are maintained separately by each client.
4. User Responsibilities
When using our services, you agree to:
- Provide accurate and current information
- Use our services in compliance with all applicable laws and regulations
- Not misuse, interfere with, or attempt to gain unauthorized access to our systems
- Ensure that your use of our AI systems complies with applicable telecommunications and consumer protection laws
5. Intellectual Property
All content on this website, including text, graphics, logos, and software, is the property of DeliaAutomation and is protected by applicable intellectual property laws. Custom automation systems built for your business remain accessible to you for the duration of your service agreement.
6. Payment Terms
Payment terms, including pricing, billing frequency, and accepted payment methods, will be outlined in your individual service agreement. Failure to maintain timely payments may result in suspension or termination of services.
7. Limitation of Liability
DeliaAutomation provides AI-powered automation services on an "as is" basis. While we strive for maximum uptime and accuracy, we do not guarantee that our systems will be error-free or uninterrupted at all times. DeliaAutomation shall not be liable for any indirect, incidental, or consequential damages arising from the use of our services, including but not limited to lost revenue, missed calls due to system outages, or data loss.
8. Termination
Either party may terminate services in accordance with the terms outlined in your service agreement. Upon termination, DeliaAutomation will cease all automated communications and provide you with any data collected on your behalf upon request.
9. Privacy
Your use of our services is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. Phone numbers and SMS opt-in information collected on this website will not be shared with third parties or affiliates for marketing or promotional purposes.
10. Governing Law
These Terms and Conditions are governed by the laws of the State of Florida. Any disputes arising from these terms or your use of our services shall be resolved in the courts of Orange County or Brevard County, Florida.
11. Changes to These Terms
We reserve the right to update these Terms and Conditions at any time. Changes will be posted on this page with an updated effective date. Continued use of our services after changes are posted constitutes acceptance of the revised terms.
